1. Acceptance of Terms
By accessing or using Kolay DM ("the Platform"), operated by Artistic Digital, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform.
2. Description of Service
Kolay DM is a messaging automation and customer relationship management (CRM) platform that enables businesses to:
- Automate responses to Instagram Direct Messages.
- Automate comment interactions on Instagram posts, including sending automated Direct Messages to users who comment on specific posts.
- Send and receive WhatsApp Business messages with automated response capabilities.
- Manage customer contacts, conversations, and leads through an integrated CRM system.
3. Eligibility
To use Kolay DM, you must:
-Be at least 18 years of age.
- Have a valid Instagram Business or Creator account and/or a WhatsApp Business account.
- Have the authority to connect and manage the social media accounts you register with the Platform.
- Comply with all applicable laws and regulations in your jurisdiction.
4. Account Registration
You are responsible for maintaining the security of your account credentials. You agree to provide accurate and complete information during registration and to update it as necessary. You are responsible for all activities that occur under your account.
5. Acceptable Use
You agree to use Kolay DM only for lawful business purposes. You must not:
- Send spam, unsolicited messages, or bulk automated messages that violate Meta's policies.
- Use the Platform to harass, threaten, or abuse any person.
- Send misleading, deceptive, or fraudulent messages.
- Violate any applicable Meta Platform Policies, Instagram Terms of Use, or WhatsApp Business Policy.
- Use the Platform to collect or store personal data in violation of privacy laws.
- Attempt to reverse engineer, decompile, or disassemble any part of the Platform.
- Share your account credentials with unauthorized third parties.
- Use the Platform to provide medical, legal, or financial advice through automated messages.
6. Meta Platform Compliance
Easy DM operations through Meta's APIs. By using our Platform, you also agree to comply with:
- Meta Platform Terms and Developer Policies.
- Instagram Platform Policy and Community Guidelines.
- WhatsApp Business Policy and Commerce Policy.
We reserve the right to suspend or terminate your access if your usage violates any Meta policy, as this may jeopardize the Platform's API access for all users.
7. AI-Generated Responses
Kolay DM may use artificial intelligence to generate automated responses on your behalf. You acknowledge that:
- AI-generated responses are created based on the knowledge base and instructions you provide.
- You are ultimately responsible for all messages sent through your connected accounts, whether generated by AI or sent manually.
- AI responses do not constitute professional advice of any kind (medical, legal, financial, etc.).
- You should review and monitor automated responses to ensure accuracy and appropriateness.
8. Subscription and Payment
Access to Kolay DM features may require a paid subscription. Payment terms, pricing, and billing cycles will be communicated during the subscription process. We reserve the right to modify pricing with reasonable advance notice.
9. Service Availability
We strive to maintain high availability of the Platform. However, we do not guarantee uninterrupted service. The Platform may experience downtime due to maintenance, updates, or factors beyond our control, including changes to Meta's APIs or policies.
10. Intellectual Property
The Platform, including its design, features, code, and documentation, is the intellectual property of Artistic Digital. You may not copy, modify, distribute, or create derivative works based on the Platform without our written consent.
You retain ownership of all content you create, upload, or transmit through the Platform, including your knowledge base content, automation rules, and message templates.
11. Limitation of Liability
To the fullest extent permitted by law, Artistic Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. This includes, but is not limited to, loss of revenue, data, or business opportunities resulting from service interruptions, API changes, or automated message errors.
12. Termination
You may terminate your account at any time by contacting us or using the account deletion feature in your dashboard. We may suspend or terminate your account if you violate these Terms, Meta's policies, or applicable laws. Upon termination, your data will be deleted in accordance with our Privacy Policy.
13. Modifications
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through a notice on the Platform. Continued use after modifications constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Istanbul, Turkey.
